Last witness in Adams case to be deposed
YOUNGSTOWN — One witness has not yet testified in a hearing over whether jurors in the 2008 murder trial of Bennie Adams knew things they should not have about Adamsá criminal history.
The witness will provide that testimony by deposition, meaning she will be asked questions by the attorneys for Adams and the county prosecutor’s office in the presence of a court reporter, who will provide Judge Anthony Donofrio of Mahoning County Common Pleas Court with a transcript of the proceedings.
Monday’s hearing included testimony from many of the jurors who found Adams, now 65, guilty of killing Youngstown State University student Gina Tenney in 1985. Tenney was his upstairs neighbor in an Ohio Avenue duplex.
The remaining witness was not able to testify because of an emergency medical issue. The purpose of the hearing is to allow Donofrio to decide whether jurors obtained information about Adamsá earlier rape conviction and prison sentence before they delivered their verdicts in the case.
The hearing was ordered by a federal judge. Adamsá attorneys want Donofrio to order a new trial for Adams, who is serving a prison sentence of 20 years to life in prison. His first parole hearing is expected to happen about Aug. 1, 2028, according to the Ohio Department of Rehabilitation and Correction.
