Man charged with OVI, leaving dog in car
CAMPBELL — A man accused of leaving his dog in a freezing car while he got drunk will return to court in February after his arraignment on Tuesday.
Peter S. Prato, 72, of 12th Street, pleaded not guilty to one count of OVI (physical control) before Campbell Municipal Judge Mark Kolmacic and was released on a recognizance bond. He will return to court for a pretrial hearing Feb. 7.
The Campbell police report states that officers responded to the Diamond Bar on Robinson Road about 5:30 p.m. Sunday, where they found a drunk Prato seated in his truck with his dog, and surrounded by other bar patrons who refused to give him his keys.
The report states witnesses told police Prato had been drinking in the bar for about four hours, while his dog was left in the truck in temperatures well below 20 degrees. The witnesses told police Prato had stumbled to the truck, with some help, and had become agitated when other patrons would not let him drive home, the report states.
The report states that Prato smelled strongly of alcohol and was arrested, and his dog was placed in the back of a separate police car.
Prato was taken to the Campbell Police Department, where he was held until his arraignment. The report states he refused a breath test. Prato was notified that the dog was being seized and taken to a temporary housing kennel.
