Warren man pleads not guilty to OVI
LIBERTY — A Warren man pleaded not guilty at his arraignment Monday after being arrested on a charge of OVI by Liberty police on Tibbetts Wick Road on Saturday night.
Humphrey Leeks, 55, was charged with OVI and lanes of travel.
According to the police report, an officer was dispatched to the area of Tibbetts Wick Road and Belmont Avenue for a report of a reckless driver. The caller reported the car they were following was committing several lane violations and causing hazardous conditions for people on the road.
Based on the complaint and witnessing the car go left of center on a right-hand turn, the officer pulled over Leeks.
The report states that when speaking with Leeks, who was the only person in the car, the officer detected a strong alcoholic beverage scent coming from the vehicle. He could also hear slurred speech, and Leeks’s eyes were red, bloodshot and glassy, the report states.
When the officer asked Leeks how much he had to drink, he stated he had nothing, although it was “reasonable to believe” he consumed alcohol before driving, the officer wrote in the report.
When Leeks stepped out of the vehicle, the officer noticed he was slightly unsteady on his feet, and when he administered the horizontal gaze nystagmus portion of the field sobriety test — which looks for the involuntary jerking of the eye when it gazes to the side and is exaggerated with alcohol usage — the officer noticed Leeks moving his head intentionally to follow along.
The report states Leeks refused to attempt the one-leg stand portion of the test, so the officer then arrested Leeks for OVI.
When the officer brought him to Girard’s police department and obtained a breath sample, Leeks’s final BAC reading was 0.167, twice the state’s legal limit of 0.08.
Leeks’s bail was set at $2,500 and he was released on a personal recognizance bond. He’s set to appear back in Girard Municipal Court for a pretrial hearing Feb. 19, court records show.
