Youngstown man causes disturbance during stop
LIBERTY — A Youngstown man and Austintown woman pleaded not guilty at their respective arraignments Thursday after being arrested on multiple charges — including one active warrant — by Liberty police.
Amanda Porter, 35, was charged with drug paraphernalia and tampering with evidence, while Kevin Kuszewski, 35, was charged with obstructing official business, resisting arrest and failing to appear in court on a traffic offense charge, as well as a charge for excessive smoke or gas from his vehicle’s muffler.
According to the police report, an officer on patrol around Belmont and Colonial avenues noticed a GMC pickup truck heading northbound on Belmont with a “very loud / faulty” exhaust. The officer checked the car’s registration and noted it belonged to an older woman, not Kuszewski, who was operating the vehicle.
Upon speaking to Kuszewski and Porter, the vehicle’s passenger, and asking for personal information, both said they did not have valid driver’s licenses. Communicating with dispatch, the officer discovered his active warrant and ordered him to get out of the car because of it and his lack of license.
Kuszewski refused to, stating that they were in traffic, and began cursing and arguing with the officer. He eventually got out of the vehicle and was handcuffed.
The report states as the officer took Kuszewski to his police car, he began to use his body weight to resist the officer and continued to argue with him. The officer grabbed him by the handcuffs and dragged him over to the front of his patrol car, as another officer arrived and made contact with Porter.
While officers patted Kuszewski down, they noticed Porter was trying to hide something in her seat and middle console area, ignoring officers as they asked what she was doing and any commands to stop. They eventually ordered her out of the vehicle too, and Kuszewski began to curse and fight with the officer, bracing his body and lifting his left leg to push off of the car.
The officer eventually took Kuszewski to the ground and used force to make him calm down.
Officers eventually arrested Porter too, because they found a used glass meth pipe on her seat.
When asked about the pipe, she said she puts vape juice into it to try it and see if she likes it.
Kuszewski tried to tell a police sergeant that it belonged to him.
As the officer was filling out a citation for Kuszewski, he continued to fight, telling the officer that he would ball him up if he wasn’t in handcuffs.
Kuszewski was booked into jail on his active failure to appear in court warrant for a traffic offense, as well as fresh charges of resisting arrest and obstructing official business.
Porter, on the other hand, was charged with tampering with evidence and drug paraphernalia.
Kuszewski’s bail for resisting arrest and obstructing official business was set for $7,500 and $5,000, respectively. Porter’s bail for tampering with evidence and drug paraphernalia was set for $15,000 and $1,500. Both are to appear back in court Feb. 5, records show.
